1. Preamble
This privacy policy (hereinafter the "Policy") is intended to inform the users and visitors of the website movyx.fr and of the MOVYX platform (hereinafter the "Site" or the "Service") about the way in which MOVYX collects, uses, shares and protects their personal data, in accordance with Regulation (EU) 2016/679 of 27 April 2016 ("GDPR") and French Act No. 78-17 of 6 January 1978, as amended, on information technology, data files and civil liberties (loi Informatique et Libertés).
It applies to any person visiting the Site, requesting a demonstration, creating a trial account, or using the MOVYX platform as a User of a subscribed Customer.
With regard to Customer Data processed by MOVYX on behalf of its professional customers in the course of their use of the platform (data of their own customers, prospects and partner agencies), MOVYX acts as a processor: the terms of this processing are defined contractually with the Customer, in particular in Schedule 1 of the General Terms of Sale and Use.
2. Controller
The controller of the processing operations described in this Policy is MOVYX, a SAS (simplified joint-stock company) with a share capital of 50,000 euros, registered with the Cannes Trade and Companies Register under number 912 121 738, whose registered office is located in Cannes (06400), France, intra-Community VAT number FR76 912121738.
3. Data collected
Depending on your interaction with the Site, MOVYX may collect the following categories of data:
- Identification and contact data: surname, first name, e-mail address, telephone number, company name, job title;
- Login and account usage data: credentials, IP address, login logs, actions performed on the platform;
- Data entered through the forms on the Site: demonstration request, contact request, free trial sign-up;
- Browsing data: pages viewed, length of visit, type of device and browser, collected in particular through cookies (see Article 8).
The Site does not collect any so-called "sensitive" data within the meaning of Article 9 of the GDPR.

5. Recipients of the data
Your data is intended for the authorised internal departments of MOVYX (sales, support, technical, accounting) and, where applicable, for its processors acting on its instructions and within the limits necessary to perform their services, in particular:
- the host of the platform (see Article 9);
- the online payment provider Stripe, for the processing of transactions;
- the tools used to send transactional e-mails and provide customer support;
- the providers of audience analysis for the Site, where applicable.
MOVYX neither sells nor rents your personal data to third parties.
6. Retention period
Your data is retained for the period strictly necessary for the purposes for which it is collected:
- data relating to a contact or demonstration request that is not followed up: three (3) years from the last contact;
- data relating to an active Account: for the whole duration of the contractual relationship;
- data after termination or closure of the account: in accordance with the periods set out in Article 25 of the General Terms of Sale and Use;
- invoicing data: ten (10) years in accordance with accounting and tax obligations;
- cookies: in accordance with the periods indicated in Article 8.
7. Data security
MOVYX implements appropriate technical and organisational measures to protect your data against loss, unauthorised access, disclosure or alteration, in particular: encryption of communications (TLS), segregation of customer environments, role-based access management, access logging and regular backups.
8. Cookies and trackers
The Site uses cookies that are strictly necessary for its operation (for example to keep your session logged in or to remember your display preferences), which do not require prior consent.
The Site may also use, subject to your consent, audience measurement cookies that make it possible to analyse traffic on the Site for improvement purposes. You may withdraw your consent or configure cookies at any time through your browser settings, which allow you to refuse or delete the cookies placed. 9. Transfers outside the European Union
The data is hosted by Hostinger within the European Union. Certain processors (e-mailing, support or analytics tools) may be established outside the European Union; in that case, MOVYX ensures that appropriate safeguards are in place (standard contractual clauses of the European Commission, adequacy decision) in accordance with Chapter V of the GDPR.
10. Your rights
In accordance with the GDPR, you have the following rights over your personal data:
- Right of access: to obtain confirmation that your data is being processed and to obtain a copy of it;
- Right to rectification: to have inaccurate or incomplete data corrected;
- Right to erasure: to request the deletion of your data, within the limits provided for by law; the administrator of an Account may also close the Account from the "My account" section, which constitutes a request for the deletion of its data, handled within thirty (30) days (Article 12.7 of the General Terms of Sale);
- Right to restriction of processing;
- Right to portability of the data you have provided;
- Right to object, in particular to commercial prospecting;
- Right to give instructions regarding the fate of your data after your death.
To exercise these rights, you may contact us at the address given in Article 13, providing proof of your identity. We undertake to respond within a maximum of one (1) month from receipt of your request.
11. Complaint to the CNIL
If you consider, after having contacted us, that your rights are not being respected, you may lodge a complaint with the French data protection authority, the Commission Nationale de l'Informatique et des Libertés (CNIL) — 3 Place de Fontenoy, TSA 80715, 75334 Paris Cedex 07, France — www.cnil.fr.
12. Amendment of this policy
MOVYX may amend this Policy at any time, in particular to comply with any legal, regulatory, case-law or technical development. The applicable version is the one published on the Site on the date of your visit or of your use of the Service. In the event of a substantial change, Users with an Account will be informed by e-mail or by a notification on the platform.
